Description
The New Jersey Board of Public Utilities (NJBPU) established a non-bypassable charge on all customers. The funding target was at least 50% of 1998 DSM program collections ($215 million/yr). SB 7 specified 75% of spending on energy efficiency, 25% on renewables. A Comprehensive Resource Analysis (CRA) is to be performed every 4 yrs to determine appropriate levels of funding for EE and RE. A separate Universal Service Fund (USF) was set up for low-income programs. In March 2001 the NJBPU ordered $358 million over 3 yrs to energy efficiency and renewables programs. In March 2002 a $15 million interim low-income assistance program was approved.

II. ADMINISTRATION

Administering Entity:
Programs are provisionally administered by each utility, with oversight and reporting to the NJBPU. The intent is to select an Independent Statewide Administrator after the first year of provisional administration. To this end, the NJBPU hired a consultant to perform a Comprehensive Resource Analysis (CRA). This report, known as the Davies report, was submitted to NJBPU on April 18, 2002, and is currently under review and public comment. Comments regarding this report were required to be submitted by June 7, 2002 to board.secretary@bpu.state.nj.us.

III. FINANCING

Of this 75% will go toward energy efficiency (EE) and 25% toward renewable energy (RE) programs.

Funding Source: Ratepayer charge (Floor of $107.5 million/yr for EE and RE combined.)

Charge:
1.35 mills/kWh for new energy efficiency programs
0.16 mills/kWh for existing low-income programs. (The USF rate for low-income programs has not yet been determined - litigation is currently pending.)

V. POLICY/PROGRAM ASSESSMENT

Reporting Requirements
Every four years the New Jersey Board of Public Utilities shall initiate a proceeding and cause to be undertaken a comprehensive resource analysis of energy programs, and within eight months of initiating such proceeding and after notice, provision of the opportunity for public comment, and public hearing, the board, in consultation with the Department of Environmental Protection, shall determine the appropriate level of funding for energy efficiency and renewable energy programs.
