It's not the fact that it's biodiesel, it's the fact that you've evaded the 
tax. Running your car on untaxed agricultural 'red' diesel is also illegal. I 
think the rules should be changed so you pay little tax on biodiesel made 
from 'waste' oil, but the people being prosecuted were simply committing tax 
fraud.
