SB: Update on Road Closures



The issue of road closures between Rio Rancho and the Town of Bernalillo
still lingers on.  Just recently we have added a new twist to things.  The
roads that were fenced and burmed lie along a section line and per the
subdivision regulations they are supposed to be 40 feet wide.  Two weeks ago
I visited with Ron Abousleman, the Town Manager, Joe Herrera, the Utility
Engineer for PNM, and Melvin Martinez, Planning and Zoning, Town of
Bernalillo to advise them that they were incorrectly placing a new power
pole line in the wrong place.  The new pole line was off the right -of-way
11 to 15 feet into the road.  As usual, Melvin said, "What's it to you, you
live in Rio Rancho", Abousleman said he'd make some calls and Joe said,
"That's were we agreed to put it".  We are now down to less than a 25 foot
wide roadway due to the pole line. Will it get any worse?

The District attorney is still involved and requested of me to meet and
address the Town Council to see if the matter could be resolved without
trial.  After some procrastination I thought I'd prepare for the worst and
still be ahead of the game with a class action suit.

I have prepared the following that I will be sending out in the next few
days.  Any suggestions or recommendations are appreciated.

Dear Mayor Charles Aguilar and Town of BernalilloTrustees,

Acting as Advocate Pro Se under the Freedom of Information Act, I request
information on the following:

Within the Town of Bernalillo, all activities affecting the status of Camino
Alto between the north boundary terminus and on or about Idalia Street on
the south and information on annexation of territory from the County of
Sandoval for the period from 1965 to March 29, 2002 and other Town of
Bernalillo actions as noted;

1. All documents relating to § 3-7-18 annexation to include Town Council
motions and actions, meeting notes of all staff members, minutes of
commissions, correspondence of every type and all formats between the Town
of Bernalillo and County Commissions, maps, surveys, State and County memos,
notes and correspondence, written or documented citizen concerns between
1965 and March 29, 2002;
2. Documents relating to the installation of a water line along the easterly
side of Camino Alto right-of-way utility easement to include all Town
Council actions leading to approval of the project, correspondence to and
from engineers, surveyors, Town Administrators and other staff personnel and
consultants, maintenance records, citizen concerns and complaints, traffic
accidents or other issues relating to installation, operation and
maintenance of said water line;
3. Documents including Town Council motions and actions, meeting notes of
all staff members, minutes of commissions, correspondence of every type and
all formats between the Town of Bernalillo and County Commissions, maps,
surveys, State and County memos, notes and correspondence, written or
documented citizen concerns relating to a variance or exception to the
County of Sandoval approval of street plats (§ 3-19-7) prior to or
subsequent to annexation;
4. Documents including Town Council motions and actions, meeting notes of
all staff members, minutes of commissions, correspondence of every type and
all formats between the Town of Bernalillo and County Commissions, maps,
surveys, State and County memos, notes and correspondence, written or
documented citizen concerns relating to a variance or exception to the
County of Sandoval acceptance of plats that include utility easements and
dedicated streets for public use (§ 3-20-11) prior to or subsequent to
annexation;
5. Documents including Town Council motions and actions, meeting notes of
all staff members, minutes of commissions, correspondence of every type and
all formats between the Town of Bernalillo and County Commissions, maps,
surveys, State and County memos, notes and correspondence, written or
documented citizen concerns relating to a variance or exception to the
County of Sandoval approval of plats and dedicated streets along and
including Caminio Alto (§ 3-20-6) prior to or subsequent to annexation;
6. Documents including Town Council motions and actions, meeting notes of
all staff members, minutes of commissions, correspondence of every type and
all formats between the Town of Bernalillo and County Commissions, maps,
surveys, State and County memos, notes and correspondence, written or
documented citizen concerns relating to a variance or exception by the Town
of Bernalilllo barring use or restriction of public streets and roadways (§
3-7-18) prior to or subsequent to annexation;
7. Documents including Town Council motions and actions, meeting notes of
all staff members, minutes of commissions, notes and memos from the Mayor
and Trustees to the Town Manager, Police Chief or other personnel;
correspondence of every type and all formats between the Town of Bernalillo
and Public works personnel, memos, notes and correspondence, work orders,
maintenance work orders or other instructions, written or documented citizen
concerns or complaints that authorized the closure of the west to east roads
by earth mound along Camino Alto;
8. Documents including Town Council motions and actions, meeting notes of
all staff members, minutes of committees, notes and memos from the Mayor and
Trustees to the Town Manager, Police Chief or other personnel;
correspondence of every type and all formats between the Town of Bernalillo
and Public works personnel, memos, notes and correspondence, work orders,
maintenance work orders or other instructions, written or documented citizen
concerns or complaints that authorized the installation and maintenance of a
fence within a public right-of-way on Camino Alto;
9. All documents, memos, notes, post-it notes, phone logs, recorded
messages, written instructions, directives and electronic media messages on
or about August 20, 2001 relating to the installation of a fence on a public
right-of-way road on Camino Alto and Lincoln Road reported to the Police
Department, Town of Bernalillo;
10. All documents, memos, notes, post-it notes, phone logs, recorded
messages, written instructions, directives and electronic media messages
from Ron Abousleman, Melvin Martinez or Joe Herrera, Public Service Company
of New Mexico, relating to a variance from utilizing the established utility
easements for installation of a utility pole line on Camino Alto or other
documents permitting the installation of a utility pole line;
11. All surveys, maps, documents, memos, notes, post-it notes, phone logs,
recorded messages, written instructions, directives and electronic media
messages from Ron Abousleman, Melvin Martinez or Joe Herrera, Public Service
Company of New Mexico, relating to the installation of a utility pole line
on a public right-of-way (Camino Alto).

As Advocate Pro Se I hereby authorize the expenditure of $500 to defray any
copying, reproduction or recording expense that may be required to comply
with this request.  In the event that reproduction costs exceed the amount
of $500, please contact me at (505) 238-1485.

Upon receipt of the requested information under the Freedom of Information
Act, I request to address the Town Council at the last meeting in April
2002, regarding the issues noted.  A written response as to approval or
disapproval to address the Council is this requested.
